Guardianship
A guardian is a person who has both duty and legal authority to make day-to-day and long term decisions for a person (referred to as a ward) who can no longer make such choices for himself or herself. Operating under Court appointment, a guardian is responsible for the following:
- Living arrangements
- Health care
- End-of-life decisions
- Transportation and other personal needs
Because of the seriousness involved in appointing a guardian for someone who is older, or has the declining ability to care for themself, a seasoned attorney can be of great help in assuring these important decisions are made in an informed manner, and executed properly.
Conservatorship
In a conservatorship, a designated person is appointed as responsible for tending to a client's financial needs or wishes. This Conservator may be responsible for things like:
- Asset management
- Bills and other financial responsibilities
- Paying for living arrangements
- Health care costs
- Transportation expenses
- Determining extent and availability of insurance and other benefits
To be established Guardianship and Conservatorship requires a court hearing, intervention of an independent guardian ad litem and medical testimony. Each role must be executed with care and dignity, as it involves the ward's ability to control decisions relating to:
- Medical care
- Place of residence
- Financial assets
- Legal proceedings
- Disposition of assets
Given the sensitivity of many of these issues, it is important to have an experienced and compassionate attorney assist you with establishing a conservatorship. Ken Labowitz devotes his practice exclusively to this type of law. Anne Heishman has also dedicated herself to service to clients in need of assistance of this kind.
Estate Administration
Estate administration is the accumulation and disposition of an estate, subject to review by a Court appointed Commissioner of Accounts.
